This policy explains how JOBORTIC INDIA PRIVATE LIMITED handles cancellations, replacements, credits, and refunds for Employment & Staffing Solutions and Digital Marketing Services.

Service-first

Credits and replacements preferred over cash refunds.

General Principles

  • Professional service fees are typically non-refundable once work commences.
  • Where possible, we offer service credits or replacements rather than cash refunds.
  • Platform media budgets (e.g., Google/Meta) are governed by the respective platform’s policies.
  • All remedies are subject to the signed Agreement (proposal / work order / MSA) and applicable Indian law.

Employment & Staffing Solutions

Permanent Recruitment (Success-Fee)

  • Fee trigger: payable upon candidate joining.
  • If candidate leaves within warranty window: we provide a free replacement as first remedy.
  • If replacement not possible within agreed window: we may offer a pro-rated service credit against future positions. Cash refunds are not standard.

Temporary & Contract Staffing / Payroll (PEO/EOR)

  • Billed monthly based on actual headcount and days worked.
  • Cancellation: requires 30 days’ written notice to offboard resources and close statutory filings.
  • Amounts for services already rendered or statutory payments already initiated are not refundable.

Compliance, BGV, Facility & Workforce

  • Where third-party fees (e.g., background checks, statutory filings) are incurred, these are non-refundable once initiated.
  • Service credits may be considered if materially incomplete work is attributable to us.

Digital Marketing Services

Retainers & Projects

  • Advance/retainer covers planning, resourcing, and activation; non-refundable after kickoff.
  • Cancellation: provide 30 days’ notice. Any unused future period may be converted to a service credit.
  • Partially completed work (e.g., creatives, landing pages, audits) delivered up to the effective cancellation date remains payable.

Media Budgets (Ads)

  • Budgets are typically paid directly to platforms; refunds (if any) are as per platform policy.
  • Where funds pass through a client-owned ad account, remaining balances stay in that account.

How to Request Cancellation or Credit

  1. Send a written request referencing your Agreement and the specific services to be cancelled.
  2. We will acknowledge and outline the effective date, transitional actions, and any applicable credit calculation.
  3. Credits, if approved, are issued in writing and applied to future invoices within the validity period stated.

Exceptions & Exclusions

  • Delays or failures caused by factors beyond our control (force majeure, platform outages) are excluded.
  • Refunds/credits are not available for outcomes dependent on market conditions, candidate availability, or third-party platform policies.
  • Breach of Agreement, misuse, or non-payment may void remedies.

Governing Law & Disputes

This policy is governed by the laws of India. The courts at Gurugram, Haryana shall have exclusive jurisdiction.
